Go Potatoes – Terms of Service

By accessing or using Go Potatoes (“we”, “us”, “our”), you agree to these Terms of Service (“Terms”). If you do not agree, you must not use our services.

1. Description of Service

Go Potatoes is a personal shopping and procurement service. We act as your agent to source and purchase products from third-party retailers on your behalf.

We are not the seller of the products unless explicitly stated. All products are supplied by third-party merchants.

2. Eligibility and Use

You must:

  • Be at least 18 years old (or have parental/guardian consent)
  • Provide accurate and complete information
  • Use our service only for lawful purposes

You agree not to misuse our service, including fraudulent activity, reselling restricted goods, or violating applicable laws.

3. Orders and Pricing

  • Prices (including product cost, service fees, and delivery) are calculated at checkout where possible.
  • Prices may change due to:
    • Supplier price changes
    • Currency fluctuations
    • Shipping or handling adjustments
  • For bulk, custom, or oversized orders, pricing may require manual quotation.
  • We reserve the right to cancel or refuse orders at our discretion (e.g., supplier unavailability, pricing errors).
  • Subscriptions
  • When you purchase a subscription you'll receive repeat deliveries. These are based on the subscription duration and frequency that you select. Your payment details will be stored securely at Shopify and you'll be charged for each of these deliveries, unless you choose to pay in advance. Some subscriptions may auto-renew at the end of their duration. If you don't want to renew a subscription you can cancel it.
  • If you want to cancel or change your subscription, you can do it at any time. Your order confirmation emails have links to your order. You can manage your subscription from there. 

4. Our Role as Agent

By using our service, you acknowledge that:

  • We purchase goods on your behalf from third-party sellers
  • Contracts for the sale of goods are between you and the supplier, not Go Potatoes
  • We do not control product quality, authenticity, safety, or legality

5. Shipping, Delivery, and Risk

  • Delivery is carried out by third-party couriers.
  • Estimated delivery times are not guaranteed.
  • Risk of loss or damage may pass to you upon dispatch or delivery (depending on courier terms).
  • Even though we will make a claim for you to the courier company (and issue refund or replacement once such claim is fully approved by the courier company), we are not responsible for:
    • Courier delays
    • Lost or damaged parcels (though we may assist with claims)

6. Returns, Refunds, and Cancellations

  • We do not accept any returns unless required by law.
  • Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right. Make sure you send us photos for the issues (including the affected products with their inner packaging and outer packaging). We can't accept any damaged or missing claims once your delivery is signed for or left at the agreed "drop-off" area.

7. Limitation of Liability

To the maximum extent permitted by law:

  • Go Potatoes is not liable for:
    • Product defects, quality, or safety
    • Supplier actions or omissions
    • Delivery delays or failures
  • We are not responsible for any:
    • Indirect, incidental, special, or consequential damages
    • Loss of profits, data, or business opportunities

Our total liability (if any) is limited to the amount you paid for the relevant order.

Nothing in these Terms excludes rights you may have under applicable consumer laws, including the New Zealand Consumer Guarantees Act 1993, where applicable.

8. Disclaimer of Warranties

Our service is provided “as is” and “as available”.

We do not guarantee that:

  • The service will be uninterrupted, secure, or error-free
  • Information provided is accurate or complete at all times

We disclaim all warranties to the extent permitted by law, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

9. Indemnity

You agree to indemnify and hold harmless Go Potatoes and its team from any claims, losses, or liabilities arising from:

  • Your use of the service
  • Your breach of these Terms
  • Your violation of any law or third-party rights

10. Changes to These Terms

We may update these Terms from time to time. When we do:

  • We will update the “Last updated” date
  • Continued use of the service constitutes acceptance of the updated Terms

11. Governing Law

These Terms are governed by the laws of New Zealand.

You agree to first contact us to resolve any dispute informally before pursuing legal action.

12. Entire Agreement

These Terms constitute the entire agreement between you and Go Potatoes regarding the service and supersede any prior agreements.

If any provision is found unenforceable, the remaining provisions will continue in full effect.
